2. Legal Foundation – NIMC Act 2026
CheckMyNINBVN operates in accordance with the National Identity Management Commission (NIMC) Act 2026, signed into law on June 26, 2026, which repeals and replaces the NIMC Act 2007. Under Nigerian law, it is a legal requirement that no person shall access, verify, retrieve, or use another individual's NIN or BVN information without that individual's explicit consent.

The NIMC Act 2026 significantly increases penalties for identity-related offences compared to the 2007 Act, including custodial sentences for fraudulent registration or unauthorized access, and higher minimum fines for corporate entities. Violation of the consent requirement described above constitutes an offense punishable under the NIMC Act 2026 and related Nigerian data protection and cybersecurity laws, and may attract these enhanced penalties.
3. Eligibility and User Obligations
To use CheckMyNINBVN:
- You must be at least 18 years old or duly authorized by an organization.
- You must provide accurate, lawful information when creating an account.
- You agree not to use the platform for:
- Fraudulent activities or impersonation;
- Accessing another person's information without consent;
- Forgery, money laundering, or criminal purposes;
- Spreading false or misleading data.
You agree that any illegal use of this platform may lead to account suspension, reporting to law enforcement authorities, and civil or criminal prosecution under applicable Nigerian laws.
4. Consent and User Responsibility
4.1 Obtaining Consent
Before submitting any verification request (NIN or BVN), the user must:
- Obtain the data subject's explicit consent, either written, digital, or recorded.

4.2 User Liability

If a user violates this clause, they shall bear all civil and criminal liabilities, including fines, penalties, or prosecution by the National Identity Management Commission (NIMC), the Nigeria Data Protection Commission (NDPC), or any other authority, up to and including the enhanced penalties introduced under the NIMC Act 2026.
6. Data Privacy and Protection
CheckMyNINBVN operates under the Nigeria Data Protection Act (NDPA) 2023 and ensures data is transmitted securely using encryption and token-based authentication.
We process verification requests based on:
- User's lawful purpose, and
- Data subject's consent.

7. Service Access and Availability
We strive to ensure continuous service uptime, but we make no guarantees of uninterrupted access. Downtime may occur due to system maintenance or external factors.
CheckMyNINBVN shall not be liable for losses arising from service interruptions.
8. Fees, Refunds, and Transactions
All service fees are displayed clearly on the platform.
Once a verification request has been successfully processed, no refunds will be made.
Fraudulent payment activities will be reported to authorities and may result in immediate account suspension.
9. Disclaimer of Liability
CheckMyNINBVN acts solely as a verification intermediary. We are an independent platform and are not NIMC and not an agency of the Federal Government of Nigeria.
We do not generate, own, or alter any official identity records.
We provide a secure channel to confirm data validity as permitted by law.
Therefore, we:
- Do not guarantee that all verification results are free from external database errors.
- Shall not be liable for any misuse, misinterpretation, or unlawful application of results obtained through our services.
- Disclaim all responsibility for unauthorized verifications conducted by users without consent.
10. User-Indemnity Clause
You agree to indemnify and hold harmless CheckMyNINBVN, its officers, developers, partners, and affiliates from any loss, damage, claim, fine, or legal cost arising from:
- Your failure to obtain consent before verification;
- Your violation of the NIMC Act 2026, the NDPA, or other Nigerian laws;
- Your misuse or abuse of our API or platform.
All liabilities from illegal use rest solely with you.
11. Prohibition of Criminal and Fraudulent Use
CheckMyNINBVN maintains a zero-tolerance policy for illegal activities.
Using this website or API for fraudulent verification, impersonation, or criminal schemes is strictly forbidden.
Violators will face:
- Permanent suspension of access;
- Blacklisting of IPs and credentials; and
- Reporting to law enforcement, including NIMC, the NDPC, and the EFCC (Economic and Financial Crimes Commission).
12. Termination of Account
We reserve the right to suspend or terminate any account that:
- Engages in unauthorized verification;
- Fails to comply with these Terms;
- Submits fraudulent or illegal requests.
Termination may occur without notice if we believe the user poses legal or reputational risk.
13. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria.
Any dispute shall be resolved under the jurisdiction of the High Court of the Federal Capital Territory or appropriate State High Court.
14. Amendments
We may modify or update these Terms periodically to reflect changes in laws (including future NIMC or NDPC regulations) or our services.
